California State University Long Beach NCAA Attestation Policy 

California State University, Long Beach is committed to the overall well-being and safety of our student-athletes and campus community. The athletics department is committed to be informed on, integrated in, and compliant with institutional policies and processes regarding sexual violence prevention and proper adjudication and resolution. Long Beach State will annually educate all student-athletes, coaches and staff on sexual violence prevention, intervention, and responses, to the extent allowable by state law and collective bargaining agreements.

Long Beach State will annually collect disclosures from all student-athletes (new and returning) related to any conduct of the student-athlete that resulted in discipline through a Title IX proceeding or in a criminal conviction for sexual, interpersonal or other act of violence.1 Long Beach State will collect the forms in a manner that does not impact a student's admission to Long Beach State in compliance with the standards of California Education Code Section 66024.5. Current and prospective student-athletes of Long Beach State must fill out a disclosure form to the best of their knowledge on an annual basis. Providing false information or failing to disclose may result in ineligibility for athletics team participation and financial aid, as well as discipline under the Long Beach State Conduct Code (PDF). All information will be kept confidential to the extent authorized by applicable law.

Procedure for California State University Long Beach to Request Information from Other Institutions Regarding Disclosed Information
 
If a new, returning or transfer student-athlete indicates on their disclosure form that they have been disciplined for a Title IX proceeding or have been criminally convicted of sexual, interpersonal or other acts of violence, the form will be provided to the Office of Title IX and the Office of Student Conduct. The student-athlete will be sent a link to complete the NCAA Student-Athlete Attestation Form, which the student- athlete would complete and sign through DocuSign. Within this form is a FERPA release, which allows Long Beach State to speak with previous institutions if necessary to gather additional information.  Once the Student-Athlete Attestation Form is completed through DocuSign, the completed form will be provided to the Office of Title IX. A representative of the Title IX office will follow up with the individual and their prior institution(s) Title IX and/or Student Conduct offices to request further documentation by sending a letter requesting a narrative summary and sharing the individual's FERPA form. 

The Title IX Office will maintain a record of all requests for information and the responses received from the other institution. Any further documentation provided by the student-athlete, or the prior educational institution will be reviewed by the Office of Title IX.

Protocol for Response to Information

The Title IX Office will be notified, consulted and assist in interpreting information received from other institutions. The Director of Athletics (or designee) will consult with the Title IX Office, the Office of Student Conduct and any other appropriate campus personnel to determine if the student may be a member of an Athletics team roster. Relevant information that will be considered includes as much information as possible about the student's history, a risk assessment of the student which considers whether the student's history regarding any prior misconduct as well as any mitigating factors would make them safe for participation within the student-athlete community. A rubric of standards will be applied consistently when making this risk assessment.

Long Beach State will comply with all state laws and CSU policies related to the contents of any information it receives including California Education Code Section 67362 which prohibits student-athletes convicted of certain crimes from competing in intercollegiate athletics until they successfully complete probation or their prison term and parole.

Protocol for Requests from Other Institutions for NCAA Attestation Related Information

In a matter consistent with federal and state law, Long Beach State agrees to share relevant discipline information and incomplete Title IX proceedings with the institution a student-athlete is transferring to.

All requests received from other institutions will be directed to and reviewed by the Office of Title IX via OED@csulb.edu.  Any such request which requires the release of any Long Beach State records (e.g. documentation from investigation, etc.) must be reviewed by Campus Counsel prior to the release of the records.  The Title IX Office will maintain records of all information requests received and responses provided.

An annual cross-check will be completed to ensure the institution the student-athlete transferred to requested and received relevant information. Compliance staff will provide the Title IX staff with a list of the schools where outgoing transfers have matriculated.

1A person who has been disciplined through a Title IX proceeding or criminally convicted, regardless of the degree, and whether the result of a plea or court determination, of either of the following:  Interpersonal Violence: Violence that is predominantly caused due to the relationship between the victim and the perpetrator, including dating and domestic violence. Sexual Violence: A term used to include both forcible and nonforcible sex offenses, ranging from sexual battery to rape. Other Acts of Violence: Crimes including murder, manslaughter, aggravated assault or any assault that employs the use of a deadly weapon or causes serious bodily injury.
 
2Crimes involving individuals that are prosecuted as an adult and is convicted of a violation of Section 187, 209, 210, 211, 220, 243.8, 245, 261, 262, 264.1, 286, 287, 288, 288.5, 289, or 459 of, or former Section 288a of, or is convicted of attempted murder pursuant to subdivision (a) of Section 664 of, the Penal Code.


This Student-Athlete Attestation form has been prepared in compliance with the 2017 National Collegiate Athletic Association (NCAA) Board of Governors Policy Addressing Sexual Violence.
 
Beginning in the 2022-2023 school year, member institutions are required to annually gather information regarding prior sexual misconduct perpetrated by any current, prospective, or transfer student athletes and applicants. In compliance with this policy, California State University Long Beach (CSULB) is requiring all current and prospective student athletes to annually disclose whether they have: (1) been disciplined through a campus proceeding for or (2) been criminally convicted of sexual violence, interpersonal violence, or other acts of violence. These forms of misconduct have been defined by the NCAA Board of Governors as described below:
 
  • SexualViolence:A term used to include both forcible and nonforcible sex offenses, ranging from sexual battery to rape.
  • InterpersonalViolence: Violence that is predominantly caused due to the relationship between the victim and the perpetrator, including dating and domestic violence.
  • OtherActsofViolence:Crimes including murder, manslaughter, aggravated assault, or any assault that employs the use of a deadly weapon or causes serious bodily injury.
 
The questionnaire below has been formulated to enable CSULB to comply with the current NCAA guidelines. Please answer truthfully and note that answering "yes" to a question will not necessarily impact your eligibility to enroll or participate in a CSULB Athletics program.

However, answers found to be false may subject an athlete/applicant to discipline under the CSULB Student Code of Conduct and impact eligibility for continued participation in athletic programs.
 
Along with this form, you will be required to sign a Family Educational Rights and Privacy Act (FERPA) release form, which will allow your prior student records involving any of the covered forms of misconduct (sexual violence, interpersonal violence, or other types of violence, as defined above by the NCAA guidelines) to be released to specific CSULB offices outlined in the release. All records obtained by CSULB will be protected by FERPA as confidential student records to the fullest extent permitted by law.
 
Note: Any information gained related to a current or prospective student's criminal conviction because of this attestation process will not be used in consideration with current or future employment at California State University Long Beach.
